De advocaat en ethiek

De bekende jurist Pitlo (A. Pitlo, Evolutie in het privaatrecht, Groningen: H.D. Tjeenk Willink 1972, p. 102) spreekt ten aanzien van bepaalde advocaten over het ‘half-intellect’ dat zich door geleerddoenerij tegenover de massa staande moet zien te houden. De publicaties die uitermate kritisch zijn over advocaten zijn van alle tijden en de eerste dateren al van voor het oude Rome. In dit verband moet ook François Rabelais (1494-1553) worden vermeld en (min of meer op zijn voetspoor) Honoré Daumier (1808-1879). De spotprenten van Daumier in de serie ‘Les gens de justice’ zijn alom bekend.

I’m thrilled to learn from Robert Ambrogi’s blog that “Karel’s Legal Blog” has been archived in the Library of Congress:

On the Internet there is no rule against perpetuities. To the contrary our perpetuation seems assured. Latest case in point: the new Legal Blawgs Web Archive from the Library of Congress. Yes, just as the LOC is archiving all of our tweets, turns out it is also archiving a selection of legal blog posts, and has been doing so since March 1, 2007. (…)

De advocaat in de wereld van Peter Stuyvesant

Wat is de wereld van ‘Peter Stuyvesant’? Enerzijds is er de historische persoon (ca. 1611-1672) die in 1635 in dienst trad bij de West-Indische Compagnie en die vanaf 1643 het koloniale bevel voerde over Aruba, Bonaire en Curaçao. Zijn naam is ook onverbrekelijk verbonden met ‘Nieuw Nederland’, een grondgebied waarop zich ook New York bevindt. Anderzijds is er het begrip ‘Peter Stuyvesant’ dat staat voor ‘glitter & glamour’: maatpakken, dure auto’s, mooie villa’s en een bijbehorende flamboyante levensstijl. De gelijknamige sigaret mag in dit rijtje niet ontbreken.

De advocaat als taalvirtuoos

De taal is hét instrument van de advocaat. De taal gebruikt hij om afspraken vast te leggen, adviezen uit te brengen, processtukken te schrijven, sommatiebrieven te sturen, een pleidooi te houden of gesprekken met cliënten of wederpartijen te voeren, declaraties te versturen, kortom: om zijn vak uit te oefenen. Voor velen is wat advocaten opschrijven maar moeilijk te doorgronden. Dat komt onder meer doordat wet- en regelgeving nogal formeel en in indirecte vorm zijn geformuleerd, terwijl gebruik wordt gemaakt van tal van abstracte begrippen. De advocaat als held van de rechtsstaat

Over de advocaat als held van de rechtsstaat kunnen we kort zijn. Tot op belangrijke hoogte kunnen we de advocaat aanmerken als de ultieme beschermer van de rechtsstaat. In de rechtsstaat neemt ‘de’ overheid een bijzondere plaats in: de overheid (de diverse wet- en regelgevende organen, al dan niet in de vorm van zelfstandige bestuursorganen) maakt niet alleen de regels waaraan wij ons moeten houden, maar beschikt ook over uiteenlopende machtsmiddelen om de naleving daarvan af te dwingen.

Een advocaat met lef

Voordat wij in 1995 bij het toenmalige Loeff Claeys Verbeke kantoorgenoten werden (hij was daar partner en ik werd daar medewerker), was ik advocaat Allard Voûte al enkele keren in grote zaken tegengekomen. Een tegenstander van formaat. Maar ook een advocaat met sterk ‘eigen-zinnige’ trekken. Zo begonnen schikkingsonderhandelingen een keer met het door Allard afscheuren van de eerste bladzijde van een door mij zorgvuldig in concept opgestelde overeenkomst, omdat hij verkouden was en geen zakdoek bij zich had. De advocaat als ambachtsman

Deze uitspraken zou je zomaar ergens kunnen horen: “De rechtenstudie is een stoffige studie. Je moet veel boeken lezen en vooral veel uit je hoofd leren. Maar gelukkig is het geen moeilijke studie. Het is zo’n beetje de makkelijkste studie om een academische graad te halen.” Is dit alles nu waar? Dat hangt er vanaf, en het hangt vooral van jezelf af. Voor ‘marginalisten’ en notoire ‘oppervlaktedenkers’ zal dit alles in meer of mindere mate wel opgeld doen. Finally, note that rather simple examples have been taken here. However, many suits are complicated with regard to their subject matter. In this connection disputes about complicated take-over issues, disputes between investors and an investment fund, disputes with a contractor or architect about a building or disputes about intellectual property come to mind. All these types of dispute require from advocates much more knowledge of and experience with litigation. Zou je niet af en toe iets over advocaten en hun beroep op je weblog moeten zetten, vroeg laatst iemand aan mij. Een goed en vooral leuk idee! Injunctive relief

Apart from seizures it is also possible to consider an application for interim injunctive relief (voorlopige voorziening). The Judge for Interim Relief can render so-called provisional relief, for instance order a building freeze or order the counterparty to pay an advance on the compensation. Such a provision is called provisional because it is a measure in the interests of maintaining order to which the court dealing with the principal case is not bound. Proceedings in various jurisdictions

Sometimes cases which are strongly interrelated to each other are brought before different courts. For instance you instigate proceedings with the court in Curacao and your counterparty instigates proceedings at the same time against you before the court in Aruba or in Sint Maarten. Duty to submit exhibits

It can of course happen that it is not a plaintiff but the defendant or a third party who has the documents by which the plaintiff can prove the existence and extent of his claim. There is a separate procedure by which such documents can be demanded.
