“Ik geef Facebook geen toestemming om mijn foto’s te gebruiken.” Overal op Facebook verschijnen dit soort berichten. Deze Facebookgebruikers zijn het niet eens met de voorwaarden waaronder zij van Facebook gebruik mogen maken. Persoonlijke gegevens en foto’s die zij op Facebook hebben geplaatst mogen van hen niet door Facebook worden gebruikt.

Wie zich aanmeldt bij Facebook aanvaardt de voorwaarden die Facebook heeft opgesteld. Die voorwaarden kunnen niet eenzijdig door de gebruiker worden gewijzigd. Het plaatsen van een tekst op een profielpagina waarin eenzijdig beperkingen aan Facebook worden opgelegd heeft juridisch dan ook geen waarde.

THE CURACAO BAR ASSOCIATION

Something about the early period

The Curaçao Bar Association was established on Saturday 11 June 1977 in the Ala Blancaroom of the Curaçao Plaza Hotel. The Bar is an association (with corporate personality) for advocates (attorneys, lawyers) practicing on the island. Erich Zielinski was the first President of the Bar; he resigned on 11 July 1978. The initial Board consisted of W. Knoppel (Vice-President), A. Richardson (Secretary) and R. Daantje (Treasurer).

The act on corporate law (Book 2 Curaçao Civil Code) governs the NV (‘public limited liability company’) and BV (‘private limited liability company’). These companies can be used for group finance or holding activities, (international) joint-ventures, funds, structured finance, as a Curaçao Trust and for “plain-vanilla” (local) activities.

FATCA AND THE US – DUTCH INTERGOVERNMENTAL AGREEMENT

In connection with the Foreign Account Tax Compliance Act (“FATCA”), the government of the Netherlands entered into a Model 1 Intergovernmental Agreement (“IGA”) with the United States (click here). Under the Dutch IGA, Netherlands financial institutions would report required information to the Netherlands tax authorities, followed by an automatic exchange of the reported information to the IRS.
